0mod (api.0mod.com) is an edge microservices gateway operated by Topazly LLC ("Company", "we", "us"). By accessing or consuming endpoints provided by 0mod, whether via autonomous AI agents, programmatic API clients, or web applications, you agree to these Terms of Service.
A. Protocol & Micropayments: Services are offered via the HTTP 402 Payment Required standard. Payments are settled on-chain or via EIP-3009 transfer authorizations in USDC on the Base network (eip155:8453). All micro-payments are per-request, non-refundable, and settled at the time of service execution.
B. Service Availability & "AS-IS" Provision: 0mod microservices are edge-computed and provided on an "AS-IS" and "AS-AVAILABLE" basis by Topazly LLC. While we target 99.9% uptime and sub-second execution, Topazly LLC makes no express or implied warranties regarding uninterrupted availability, timing, or absolute accuracy of AI model outputs or third-party data sources (e.g., RDAP registries, DEX price aggregators, web fetches).
C. Limitation of Liability: To the maximum extent permitted by applicable law, Topazly LLC, its 0mod brand, and their members, officers, and operators shall not be liable for any indirect, incidental, consequential, special, or punitive damages (including loss of profits, data, or AI agent autonomous decisions) arising from your use of the API. Topazly LLC's cumulative liability for any claim shall not exceed the total micro-payment amounts received from your client wallet in the thirty (30) days preceding the claim.
D. Acceptable Use Policy: You agree not to use 0mod endpoints to:
A. Application Payload Privacy (Zero Payload Retention): Topazly LLC and 0mod do not store, log, write to disk, or retain request body content (text sent to airgap-scrub, URLs sent to stealth-dom, images sent to image-ocr-shrink). Request payloads are processed transiently in-memory within isolated Cloudflare Workers V8 execution contexts and are destroyed immediately upon HTTP response completion.
B. Workers AI Data & Training Guarantees: Endpoints utilizing Cloudflare Workers AI (Llama 3.1, Vision Llama 3.2, BGE Embeddings) operate under Cloudflare's strict developer privacy standards. No prompt inputs, text samples, images, or generated embeddings are ever used to train or fine-tune AI models by Topazly LLC, Cloudflare, or any third party.
C. Edge Network Telemetry & Infrastructure Logs: Cloudflare, as our global edge infrastructure provider, processes standard network-layer HTTP metadata (client IP addresses, request paths, HTTP status codes, user-agent strings, and timestamps) for Web Application Firewall (WAF) security, threat mitigation, and network routing, subject to Cloudflare's Privacy Policy. Topazly LLC does not sell or market network telemetry data.
D. On-Chain Settlement Ledger: Settlement transactions (USDC EIP-3009 transfer authorizations on Base) are publicly recorded on the Base blockchain ledger. Topazly LLC does not track, map, or link wallet addresses to personal real-world identities.
These terms shall be governed by and construed in accordance with the laws of the State of Washington, USA, applicable to agreements made and performed entirely within Washington by Topazly LLC, without regard to conflict of law principles.
